SAP evaluations for safety-sensitive positions

A Substance Abuse Professional (SAP) evaluation is the first required step for an employee in a DOT-regulated safety-sensitive role after a drug or alcohol violation. Who needs a SAP evaluation?

Any employee who performs safety-sensitive functions under U.S. Department of Transportation (DOT) agency regulations, and who tests positive, refuses a test, or otherwise violates DOT drug and alcohol rules, must complete a qualified SAP evaluation before returning to those duties.

Safety-sensitive status is defined by the duties actually performed, not by job title, so many roles that are not traditional driving jobs still fall under DOT SAP requirements.

Only FMCSA commercial driver's license (CDL) holders are reported to the FMCSA Drug and Alcohol Clearinghouse. Employees regulated by other DOT agencies must still complete the full SAP evaluation and return-to-duty process, even though they do not appear in that Clearinghouse.

A different kind of evaluation

What makes a SAP evaluation different?

Education or treatment is always part of the process.

A SAP cannot determine that no education or treatment is needed. The recommendation will always include at least one of the two, and our counselors will explain what is being recommended and why.

A second face-to-face evaluation is required.

After completing the prescribed program, the client meets with the SAP a second time, in person, so the SAP can verify compliance before a return-to-duty test is authorized.

Follow-up testing is prescribed.

The SAP sets a required, unannounced follow-up testing plan with a minimum of six tests in the first 12 months and a maximum duration of five years (49 CFR 40.307). Federal rules set a minimum duration of 12 months. The SAP coordinates the testing requirements with the employer's Designated Employer Representative (DER), and the employer carries out the plan.

From violation to return to duty

The process

    The employee registers in the FMCSA Clearinghouse if required (CDL holders) and opens the Violation Report section. Other DOT agencies have their own reporting and registration requirements, which we confirm with each employee individually.

    The employee selects a SAP provider and supplies the positive test result or other required violation documentation — the official Medical Review Officer (MRO) report or the employer's notice showing the verified result.

  3. 03

    The employee provides the Designated Employer Representative's contact information so required communication can take place.

  4. 04

    After payment and completion of the intake packet, the initial SAP session is scheduled.

  5. 05

    The SAP provides an Initial Report of Recommendation. The employee completes the recommended education and/or treatment and submits proof of completion. The SAP communicates with the DER as authorized.

  6. 06

    The SAP records the applicable return-to-duty eligibility status in the Clearinghouse for FMCSA CDL holders. A return-to-duty test, medical-clearance update, and follow-up testing schedule may apply as part of the process.

SAP credentials

SAP services at Chrysalis are provided by qualified Substance Abuse Professional (SAP) counselors who hold the qualification required by the U.S. Department of Transportation. The qualification requires a recognized clinical credential, clinical experience in diagnosing and treating substance-related disorders, DOT-specific qualification training, and a passing result on a comprehensive examination administered by a nationally recognized organization.

SAPs must also complete 12 hours of continuing education every three years and maintain documentation of their qualifications. The Department of Transportation does not certify or approve individual SAPs or SAP training programs; the qualification is held and maintained by the professional.

Important things to know

  • Follow-through is required within 30 days of the recommendation. If it is not followed through, it may be reported to the employer as non-compliance, and if more than 30 days pass a reassessment may be required.
  • Federal law does not permit a second opinion from a different SAP. The SAP assigned to the violation is the SAP for that violation, and a case cannot be transferred to another SAP.
  • Payment in full for the SAP assessment is required at the time of the initial assessment appointment, by cash, cashier's check or money order.
  • Confidentiality: without a signed release, information may be communicated to the collector, the Medical Review Officer, education and treatment program personnel, and the Designated Employer Representative. Reports go to the DER. On request, case records must be made available to DOT agency representatives and to the National Transportation Safety Board in an accident investigation. Confidentiality law prohibits sending information about the employee to a new employer unless the employee authorizes it in writing.

The SAP (DOT) evaluation fee is all inclusive. No processing fee is added to it.

The missed appointment fee applies when the card on file is charged 15 minutes after the scheduled start time. 24 hours' notice avoids the fee.
